If your employer is treating you as a contractor, when you are not really self employed there are many pitfalls for you.

1.  You have to pay the normal employers share of social security and medicare taxes as well as the employee share.

2.  Your employer is not paying unemployment compensation insurance, so if you get fired or laid off you cannot collect unemployment.

3.  Your employer is not paying workers compensation insurance so if you are injured on the job, your medical bills will not be covered.

In many cases the employer does not have the legal right to treat you as self employed, and there are steps that you can take, with the IRS, to challenge that.  You can immediately file form SS8 to have the IRS determine if you are a contractor or an employee, and you can file form 8919 with your tax return if your form SS8 is pending or has come back in your favor.
